আগামী জাতীয় নির্বাচনের সময়ে বিদায়ী প্রধানমন্ত্রী হিসেবে শেখ হাসিনাকে ক্ষমতায় রেখে সর্বোচ্চ ছাড় দেওয়ার সরকারি মনোভাব ধীরে ধীরে স্পষ্ট করা হবে। এ পর্যন্ত এটাই সরকারি অবস্থান। তবে মনে রাখতে হবে, আমাদের বিরোধী দল (গত ২০ বছরের) এমন কোনো ব্যবস্থায় ‘সুষ্ঠু’ নির্বাচন দেখতে চায় না, যা ক্ষমতাসীনদের দ্বিতীয় মেয়াদে নির্বাচিত করার প্রক্রিয়াকে গ্রহণযোগ্যতা দিতে পারে।
সেদিক থেকে বিদায়বেলায় ‘কিছু মন্ত্রণালয় ইসির অধীনে দিলে সুুষ্ঠু নির্বাচন সম্ভব’ বলে প্রধান নির্বাচন কমিশনার (সিইসি) এ টি এম শামসুল হুদার উক্তিকে যে বিএনপি গুরুত্ব দেবে না তা হলফ করে বলা যায়। শুধু তত্ত্বাবধায়ক সরকার হলেই চলবে না, সঙ্গে বিরোধী দলের একটা বিজয় মিছিল লাগবে। শেখ হাসিনার নেতৃত্বাধীন বিগত মেয়াদের সরকার যখন সংসদ ভেঙে দিয়ে পদত্যাগ করল, তখন বিরোধী দল সারা দেশে ‘সরকারের পতন’ ঘটানোর কৃতিত্ব দাবি করে বিজয় মিছিল করেছে। স্যার স্টিফেন নিনিয়ানের ৫+৫+১ ফর্মুলাটি আওয়ামী লীগ প্রায় মেনে নিতে বসেছিল। কিন্তু ঠুনকো অজুহাতে তা ভেঙে যায়। এবারও তেমন ঘরানার একটি সংলাপ অনুষ্ঠানের উদ্যোগের আলামত দেখতে পাচ্ছি। ব্যক্তিগতভাবে কেউ খুশি হতে পারেন যে আওয়ামী লীগ সেদিন যা প্রত্যাখ্যান করেছিল, বিএনপি যদি আজ তা গ্রহণ করতে পারে।
বর্তমান ইসি দলীয় সরকারের অধীনে স্থানীয় সরকার স্তরের নির্বাচন অনেকটাই অবাধ ও সুষ্ঠু করেছে। কিন্তু তার ভিত্তিতে সাধারণ নির্বাচন করতে পারার দাবি যৌক্তিক নয় বলেই অনেকে মনে করেন। এখন সিইসি বলছেন, ‘কতিপয় শর্ত’ পূরণ করা হলে তা সম্ভব। সেই শর্তের একটি তিনি স্পষ্ট ও নির্দিষ্ট করেছেন, সেটি হলো, ‘কিছু মন্ত্রণালয়কে’ ইসির অধীনস্থ করতে হবে। ২৭ জানুয়ারি ২০১২ সুরঞ্জিত-মঈনের বাহাস বা ‘তত্ত্বাবধায়কের’ নতুন ফর্মুলাবিষয়ক একটি নিবন্ধ লিখেছিলাম। রেলমন্ত্রী কিছু মন্ত্রণালয় ইসির অধীনে নেওয়ার ধারণাটি বাংলাভিশনের আলোচনায় উল্লেখ করেছিলেন ২৩ জানুয়ারি। এর সপ্তাহ না ঘুরতেই ব্রিগেডিয়ার (অব.) সাখাওয়াত হোসেন তাঁর দপ্তরে সাংবাদিকদের বলেন, আগামী এক সপ্তাহের মধ্যে সরকারের কাছে তাঁরা গণপ্রতিনিধিত্ব আদেশ, মানে নির্বাচনী আইন সংশোধনে একটি প্রস্তাব দিচ্ছেন। এতে নির্বাচনকালে ‘দলীয় বা যে ধরনের সরকারই’ থাকুক না কেন, তিনটি মন্ত্রণালয়—স্বরাষ্ট্র, স্থানীয় সরকার, জনপ্রশাসন এবং মন্ত্রিসভা বিভাগকে ‘অবশ্যই ইসির সঙ্গে আলাপ-আলোচনা করে’ সিদ্ধান্ত নেওয়ার কথা বলা হবে। এ প্রসঙ্গে তিনি ‘মাস্ট কনসাল্ট’ শব্দটি উল্লেখ করেন। সাখাওয়াত হোসেন বলেন, নির্বাচনকালে কী সরকার থাকবে, সেটা রাজনৈতিক প্রশ্ন। তবে যে সরকারই থাকুক, নির্বাচনকালে সচিবালয়ের ফাইল চলে আসবে ইসিতে। এ বিষয়ে ঠিক কী প্রক্রিয়া অনুসরণ করা হবে, তা আইন হলে তার আওতায় বিধি করে নেবে ইসি। সিইসির জবানিতে ২ ফেব্রুয়ারি কিছু মন্ত্রণালয় ‘অধীনে’ কথাটি এসেছে। আমরা জানি না, এই অবস্থাটি আইনগতভাবে কীভাবে নিশ্চিত করা হবে। তবে একটা সারকথা বুঝি এবং সেটা বোঝাই গুরুত্বপূর্ণ।
তিনি যে ‘কানসাল্টেশনের’ কথা বলেছেন, সেটা সভ্য সমাজে স্বাভাবিক প্রত্যাশা। কিন্তু তিনি নিজেই সাক্ষ্য দিচ্ছেন, বিগত তত্ত্বাবধায়ক সরকারের আমলেও জটিলতা দেখা দেয়। প্রশ্ন হলো, আইনে থাকলেই দলীয় সরকার তা মানতে বাধ্য থাকবে কি না।
ভাতের চেয়ে ডাল উঁচু হতে পারে না। বিধির চেয়ে আইন বড়, আইনের চেয়ে সংবিধান বড়। আর এমন কোনো আইন বা বিধি আমরা কল্পনা করতে পারি না, যা সংবিধানকে ছাড়িয়ে যেতে পারে। সেই সংবিধানের ৫৫(২) অনুচ্ছেদে বলা আছে, ‘প্রধানমন্ত্রী কর্তৃক বা তাঁর কর্তৃত্বে প্রজাতন্ত্রের নির্বাহী ক্ষমতা প্রযুক্ত হবে।’ এখন যদি কেউ বেমক্কা বলেন যে আইন বা বিধি দিয়ে এই সর্বশক্তিমান প্রধানমন্ত্রীর ক্ষমতা খর্ব করবেন, তাহলে তো প্রশ্ন উঠবেই। আর কনসাল্টেশন? সুপ্রিম কোর্টের রায় আছে, এটা মানতে প্রধানমন্ত্রী বাধ্য নন। উপরন্তু আমাদের দাস্য মানসিকতাও স্মরণে রাখতে হবে। সংবিধান সংশোধন করে বলা হয়েছে, প্রধান বিচারপতি নিয়োগের ফাইল প্রধানমন্ত্রীর কাছে যাবে না। কিন্তু আইন মন্ত্রণালয় অভ্যাস ছাড়তে পারে না।
তবে সিইসির এই কথা খুবই গুরুত্বপূর্ণ যে, যে তত্ত্বাবধায়ক সরকারের কথা বিএনপি বলছে, তা তো আগামী দুই মেয়াদের জন্য। তাহলে তারপর কী হবে? এর উত্তর হলো, সংবিধান সংশোধন করে প্রধানমন্ত্রীর ব্যক্তিগত একচ্ছত্র ক্ষমতা খর্ব করতে হবে। অন্যান্য সভ্য সমাজের মতো নির্বাহী ক্ষমতার কার্যকর অনুশীলন লিখিতভাবে দিতে হবে মন্ত্রিসভার কাছে। এটা যদি সম্ভব হতো, তাহলে ব্যক্তি প্রধানমন্ত্রীকে রেখে এতটা মারাত্মক উত্তেজনা সৃষ্টি হতো না। এটা বললে অনেকে গোস্বা করেন। তাঁদের মনে মাইনাস টু ফর্মুলা উদিত হয়। অথচ তাঁরা কিছুতেই সংবিধানের এমন সৃষ্টিছাড়া বিধান শোধরানোর কথা মুখে আনবেন না।
সিইসি ও ব্রিগেডিয়ার সাখাওয়াতের বক্তব্য অন্তসারশূন্য বলে প্রতীয়মান হয়। এ কথা বলার উদ্দেশ্য এই নয় যে বিরোধী দলের স্বপ্নের তত্ত্বাবধায়ক সরকার প্রতিষ্ঠার প্রতি শর্তহীনভাবে সমর্থন দেওয়া।
আমরা সব সময় মনে রাখব, দুই প্রধান দলই সব অবস্থায় প্রধানমন্ত্রীর হাতে সর্বময় ক্ষমতা কুক্ষিগত রাখার পক্ষে সংকল্পবদ্ধ। কিন্তু তাঁদের আশপাশে যাঁরা আছেন, বিশেষ করে সাংবিধানিক সংস্থায় যাঁরা আছেন, তাঁরা যখন পালিশ করার রাজনীতি করেন, তখনই দুঃখ হয়। বর্তমান নির্বাচন কমিশনের অনেক ভালো কাজের প্রশংসা করি। কিছুই জুটত না, যদি না তারা সেনা সমর্থনে ২০০৮ সালের সাধারণ নির্বাচনটি না করতে পারত। সুতরাং একই অঙ্গে তাদের অনেক রূপ থাকতে পারে। কিন্তু দলীয় সরকারের অধীনে কয়েকটি নির্বাচন করে তাদের বলা উচিত নয় যে সংবিধানের বিধিব্যবস্থা না বদলে দিয়ে, বিচার বিভাগের স্বাধীনতা না দিয়ে ‘কতিপয় পরিবর্তন আনলেই’ দলীয় সরকারের অধীনে ধরেই নেওয়া যাবে সুষ্ঠু নির্বাচন হওয়া সম্ভব। অবশ্য কেউ যদি গণক ঠাকুর হতে চান এবং তাতে সফলও হন, তাতে আমরা অবাক হব না। কেউ বলতে পারেন, সত্তর সালের নির্বাচন কি সেনা সরকারের অধীনে হয়নি। তখন যদি সম্ভব হয়ে থাকে, তাহলে এখন হবে না কেন। যদি কেউ বলেন, আগামী দুই বছরে সরকারি দলের জনপ্রিয়তা এতটাই কমে যাবে যে দলীয় সরকারের অধীনে নির্বাচন করলেও তাতে বিরোধী দলই ফিরে আসবে। এমনকি বিএনপি তার সব অপশাসনের কলঙ্ক ও দেউলিয়াত্ব নিয়েও তিন- চতুর্থাংশ নিয়ে সরকার গঠন করতে পারে! তাই তারা আওয়ামী লীগকে তাদের ১৯৯৬ সালের মডেলে নির্বাচন করতে দেবে না। জেনারেল এরশাদকে ‘গৃহপালিত বিরোধীদলীয় নেতা’ কিংবা তাঁকে খালি মাঠে গোল করতে দেওয়া হবে না।
ক্ষমতাসীন দল এখনো বিশ্বাস করে যে প্রধানমন্ত্রীকে চেয়ারে রেখেই তারা নির্বাচন করবে এবং সেখানে সব রকম উসকানি থাকবে, যাতে বিরোধী দল দলীয় সরকারের অধীনে নির্বাচনও বয়কট করে! এ ধরনের কল্পনাশ্রয়ী ঘটনা ধরে যুক্তিসংগত মন্তব্য করা চলে না। বেগম খালেদা জিয়া এমন কিছুই মেনে নেবেন না, নির্বাচিত প্রধানমন্ত্রী হিসেবে যাতে ফ্রিস্টাইলে সরকার চালাতে তার অসুবিধা ঠেকে। তবে ক্ষমতার বৈতরণী পার হতে প্রয়োজনে তিনি অনির্বাচিত প্রধানমন্ত্রী বা প্রধান উপদেষ্টার ওপরে ক্ষমতা কাটছাঁট করার একটা পরীক্ষা-নিরীক্ষা চালাতে পারেন। দুই নেত্রী এমন কোনো গণতান্ত্রিক ব্যবস্থা চান না, যাতে দুই দলের নেতৃত্ব দিতে তাঁদের কোনো অসুবিধা হয়। এই লেখকের স্থির বিশ্বাস দুই দল এমন কিছুই করবে না, যাতে তৃতীয় কোনো পক্ষ ঢুকে পড়ে। তৃতীয় পক্ষ নিয়ে তারা সাময়িক খেলতে পারে কিন্তু স্থায়ী হতে দেবে না।
তাই বলছি, সিইসি যখন কথাটা বলেছেনই, তখন তাঁর বা ইসির দায়িত্ব বিকল্প ব্যবস্থাটা বিস্তারিত খুলে বলা। শুক্রবার প্রথম আলোতে পড়লাম, দলীয় সরকারের অধীনে নির্বাচন সুষ্ঠু হতে পারে কি না জানতে চাইলে সিইসি বলেন, ‘অসম্ভব নয়। তবে কাজটা কঠিন। এটা করতে হলে শর্তহীনভাবে কিছু কাজ ইসির ওপর ছেড়ে দিতে হবে। এসব শর্ত না মানলে সুষ্ঠু নির্বাচন কঠিন হবে।’ আমরা কিছু কাজের তালিকাটা চাই। তিনি এটা এমন এক প্রেক্ষাপটে বলেছেন, যখন ক্ষমতাসীন দল অনুসন্ধান কমিটিতে নতুন সিইসির জন্য তাঁর নাম পাঠিয়েছে।
নারায়ণগঞ্জ নির্বাচনের পর সেনা মোতায়েন প্রশ্নে তিনি প্রথমে সংবিধান লঙ্ঘনের কথা বলে পরক্ষণেই অবস্থান পাল্টিয়েছিলেন। বলেছিলেন, সেনা চাওয়াটা তাঁদের হঠকারি সিদ্ধান্ত ছিল। তিনি সরকারের মুখ রক্ষা করেছিলেন।
নির্বাচন কমিশনার বাছাইয়ে সার্চ কমিটির ধারণা ইসিই প্রথমে দিয়েছিল। তারা যেভাবে বলেছিল, সেটি বর্তমান কমিটির চেয়ে অনেক উন্নত প্রক্রিয়া ছিল। কিন্তু সেটা সরকারি দল নেয়নি। শুধু কাঠামোটা নিয়েছে এবং ফাঁকিটা ধামাচাপা দেওয়া সম্ভব হয়েছে।
একইভাবে আমরা হয়তো দেখব, কিছু মন্ত্রণালয় হয়তো ইসির ‘অধীনে’ এসেছে। কিন্তু তা কাজ করছে না। মূল কথা হলো, নির্বাচনকালে প্রধানমন্ত্রীর ক্ষমতার কী হবে। এই একটি প্রশ্নের জবাব পেলেই অন্য সব প্রশ্নের জবাব পাওয়া সহজ হবে।
সরকারি দল চাইলে পঞ্চদশ সংশোধনীর আওতায় নির্বাচিত অন্তর্বর্তীকালীন বা তত্ত্বাবধায়ক সরকারও করা সম্ভব। তিন মাস আগে সংসদ ভেঙে যাবে। রাষ্ট্রপতি বিদায়ী প্রধানমন্ত্রী ও মন্ত্রিসভার পদত্যাগপত্র গ্রহণ করবেন। তার আগে নির্বাচন কমিশন একাধিক আসনে উপনির্বাচন করে ‘অনির্বাচিত তত্ত্বাবধায়কের’ স্থলে নির্বাচিত ‘অন্তর্বর্তীকালীন সরকারের’ পথ সুগম করতে পারে। এবং তাতে সাপও মরবে, আবার লাঠিও ভাঙবে না। কিন্তু আমাদের রাজনীতি সম্ভবত সেদিকে যাবে না। যাবে একতরফা নির্বাচন কিংবা জ্বালাও-পোড়াওনির্ভর কথিত ‘গণ-অভ্যুত্থানের’ দিকে।
তাই বলি, ‘কিছু মন্ত্রণালয়ের দরকার কী। মন্ত্রিসভা বিভাগকে দরকার কী। শুধু একজন প্রধানমন্ত্রীর ক্ষমতা সমঝোতার মাধ্যমে যে ইসি গঠিত হবে, তাকে দিন, কিংবা সমঝোতার তত্ত্বাবধায়ক প্রধানমন্ত্রীর হাতে ইসির ক্ষমতা দিন, তাহলে ‘ধরণী আর ঢাকিতে নাহি হবে’!

"নারায়ণগঞ্জ নির্বাচনের পর সেনা মোতায়েন প্রশ্নে তিনি প্রথমে সংবিধান লঙ্ঘনের কথা বলে পরক্ষণেই অবস্থান পাল্টিয়েছিলেন। বলেছিলেন, সেনা চাওয়াটা তাঁদের হঠকারি সিদ্ধান্ত ছিল। তিনি সরকারের মুখ রক্ষা করেছিলেন।" - হরপ্রসাদ শাস্ত্রী এমন চরিত্রের কথা বলে গেছেন বহু বছর আগে । সাংবিধানিক পদ, গাড়িতে পতাকা, অর্থনৈতিক সুবিধা সহ আরও আরও জায়গায় পদের প্রভাবে লোকদেখান সম্মান পাওয়ার লোভ ছাড়তে পারে এমন বাংলাদেশি পাওয়া যাবে কোথায়, কিভাবে। তার ঐদিনের দূরদর্শিতাই আজ তাকে ক্ষমতাসীনদের পক্ষ থেকে আবার ঐ পদে প্রস্তাব পাওয়ার যোগ্যতা তৈরি করে দিয়েছে ।
বার বার একটা কথাই শুধু জানতে ইচ্ছে হয় - স্থানীয় সরকার নির্বাচন আর জাতীয় সংসদ নির্বাচন কিভাবে তুলনীয় ? দেশের সব সিটি কর্পোরেশন, উপজেলা আর ইউনিয়ন পরিষদ নির্বাচনে যদি ক্ষমতাসীন দল হেরেও যায় তাতে তাদের ক্ষমতার মসনদে কি টান ফেলবে? বড়জোর এটুকু বার্তা পাবে যে পরবর্তী সংসদ নির্বাচনে ঘাম ঝরবে এর বেশি আর কি?
উপজেলা চেয়ারম্যানরা কি খুব মহাসুখে আছে । তারা অনশন করছে, নানা আন্দোলন করছে তাদের মোক্ষ পাওয়ার জন্য । আর সে মোক্ষ কার কাছে ? সাংসদ এর কাছে । সুতরাং আকাশচুম্বি সংসদিয় আসন পেয়ে ক্ষমতাসীনরা ধরেই নিয়েছিল সব নির্বাচনে তাদের প্রার্থীর বিজয় অগ্রীম এর পর চাবি ত হাতে আছে জেনেই ভদ্রলোক সাজা ।
সংসদ নির্বাচনের গুরুত্বটা কি ? একটু এদিক ওদিক, বেশি না ১৫১ / ১৪৯ - তাতেই কেল্লা ফতে আর গাড়িতে প্রধান মন্ত্রীর পতাকা উড়বে না । এই দুই রমনী খুব ভালভাবে তা জানেন । হুদা সাহেবকে বেহুদা বানাতে সেকেন্ড ই যথেষ্ট ।তত্বাধয়াক আর অন্তরবর্তী যে নাম ই হোক এদের কারিগরী চলতেই থাকবে । তবে অরাজনৈতিক তত্বাবধায়ক থাকলে শুধু একটু স্বস্তি পাওয়া যাবে যে এরশাদের মত লাঠালাঠি,বোমাবাজী হবে না ।
সাধারণ জনগন ত শুধু গায়ের ওপরের অংশে কাপড় পরা । নিম্নাংশে কাপড় নেই কখনই । কারন ভোট নামক তেলের বোতল দুই রমণীর পছন্দের ধর্ষকদের হাতে দিয়ে পেতে রেখ দেয় । নারি পুরুষ নির্বিশেষে বাজারের বেশ্যাদের মত শুয়ে থাকা । যতক্ষণ পার চালাও, যখন রক্তক্ষরন জান হরন করার পর্যায়ে পৌছায় তক্ষন আবার ঐ দুই কবিরাজের কাছেই তুলে ধরে বলা এবার একটু ফু দাও জ্বলুনি আর সহ্য হয় না । এই ভোটার রা শুধু ঐ দন্ডটার পরিবর্তন ছাড়া আর কিসের পরিবর্তন চাইতে পারে ।
